Reproductive Rights
Now that the Supreme Court has overturned Roe, abortion will remain accessible in Virginia, but without legal protection. In 2020, Virginia repealed numerous medically unnecessary restrictions on abortion access.
In February, 2025, a resolution (HJ1) to amend the Virginia constitution to protect reproductive freedom passed the House of Delegates by a vote of 51-48 and was reported (SJ247) out of the Senate Privileges & Elections Committee by a vote of 8-6.
Next Steps:
November 2025: Virginia Governer and House of Delegates elections take place.
November, 2026: Virginians vote on a constitutional amendment guaranteeing reproductive freedoms.
GA Session, 2026: General Assembly passes a constitutional amendment guaranteeing reproductive freedoms for the second time.
Virginia needs a Constitutional Amendment to protect reproductive freedom
- Virginia is the last state in the South without an abortion ban or extreme restrictions on reproductive freedom.
- Virginia saw a 76 percent increase in abortions between 2020 and 2023. (Guttmacher Institute).
- By May 2024, 30 percent of new appointments were made by patients coming from abortion ban or extreme restriction states (Virginia League of Planned Parenthood).
- A recent poll found Virginians overwhelmingly support reproductive freedoms (HIT Strategies).
